Trademarks at Software AG
            

1. Introduction

A trademark is a word, name, symbol or device that is capable of distinguishing goods or services of one company from those offered by other parties in the market. The owner of a trademark may prevent others from using its trademark. Software AG trademarks serve as a guarantee to protect the market position associating the name or logo to a quality standard, giving it a reputation of solidity and securing its credit value inside the market.Therefore, Software AG takes great care to protect its trademarks.The purpose of these trademark guidelines is to ensure that Software AG’s trademarks are used properly and remain a guarantee of source and quality. Improper use may result in a violation of trademark law.

2. Fair use of Software AG trademarks

A trademark provides the owner with an exclusive right to use and to authorize the use of the trademark. The use of Software AG trademarks usually requires permission from Software AG. In some cases, however, the use of Software AG trademarks can be lawful without permission of Software AG, provided these rules are adhered to:

 

2.1 General rules

Software AG’s trademarks can be generally used when you refer to Software AG products or services or when you indicate that Software AG products are compatible with other products.

XYZ for use with ARIS
or
XYZ compatible with Alfabet

Please avoid any likelihood of confusion to the origin of products, services or logos of Software AG.

Do not use Software AG trademarks in direct combination with any third-party product or trademark or show any Software AG product, service or logo as most prominent part of any third-party usage.

2.2 Use proper trademark symbols (® & ™)

The first or most prominent reference in a publication (press release, newsletter, manual, etc.) to Software AG products or service should be followed by an appropriate trademark symbol.

Trademark symbols are used to provide notice of a claim of rights in a trademark and indicate the status of a trademark. The use of the appropriate symbol depends on whether the trademark is registered with a trademark office or not. A trademark that has been registered is followed by the ® symbol. The use of the ® indicates that the respective trademark is registered in every country in which the trademark is used with this symbol. The appropriate symbol for an unregistered trademark is ™. The ™ can be used for all pending trademarks or for those that enjoy protection under common law. The SM symbol is equivalent to the TM symbol with the exception that SM is used for service marks instead of trademarks. Service marks identify services and not products. All trademark rules also apply to service marks as well.

The proper trademark symbol should appear directly after the trademark to which it applies. If you are not sure whether a Software AG trademark is registered in your country or not, ask our trademark experts for help. They will inform you which trademark symbol is the correct one to use with the associated mark.

Provided a product name comprises of more than one trademark, the status of the trademarks must be identified separately by the proper trademark symbol for each trademark.

In addition to the correct trademark symbol include an attribution statement in a prominent place after the first use of each trademark, such as a footnote.

Usage of several Software AG trademarks:

The name Software AG and all Software AG products are either trademarks or registered trademarks of Software AG and/or its subsidiaries and/or its affiliates and/or their licensors.

Usage of one Software AG registered trademark:

[Software AG trademark] is a registered trademark of Software AG and/or its subsidiaries and/or its affiliates and/or their licensors.

Usage of one Software AG trademark:

[Software AG trademark] is a trademark of Software AG and/or its subsidiaries and/or its affiliates and/or their licensors.



2.3 Proper use of Software AG word marks

1) Use Software AG trademarks as adjectives

Software AG trademarks are adjectives that describe products or services of Software AG. A Software AG trademark should never be used by itself as a noun or a verb but instead followed by a generic noun/term. There is only one exception “Software AG” as company name should be used as a noun and can be used in possessive form.

Example:

  1. Correct: ARIS® software is part of the Software AG Digital Business Platform
  2. Incorrect: ARIS® is a part of the Software AG Digital Business Platform

2) Do not use Software AG trademarks in plural

Software AG trademarks should be used in the singular form and may never be used in the plural form. If you need the plural form, however, make the generic term plural instead.

Example:

  1. Correct: Our customer uses two Terracotta products.
  2. Incorrect: Our customer uses two Terracottas.

3) Never use Software AG trademarks in the possessive form

Avoid using Software AG trademarks in the possessive form.

  1. Correct: The advantage of Apama® streaming analytics is you can detect patterns across fast-moving data.
  2. Incorrect: Apama’s® advantage is you can detect patterns across fast-moving data.

4) Never use Software AG trademarks in a modified form

Do not change the representation of Software AG trademarks. Software AG trademarks may not be shortened, abbreviated, altered, including capitalized, or amended in any way. This also includes different capitalization, punctuation or hyphenations. Never translate Software AG trademarks into other languages.

Example:

  1. Correct: webMethods®
  2. Incorrect: webM® or WM®
  3. Correct: The Apama® platform allows business to analyze and act on high-volume business operations and customer interactions in real time. (example hyphenates)
  4. Incorrect: The APAMA®-platform allows business to analyze and act on high volume business operations and customer interactions in real time.
  5. Correct: Alfabet® software is a Software AG product.
  6. Incorrect: Alfabet® software is a Software AG® product.

3. Proper use of Software AG logos

Do not use Software AG logos in connection with products or advertising materials unless you have an explicit trademark license from Software AG. Software AG logos may be used only in limited situations. Under no circumstances modify Software AG logos as this could cause confusion with the public. It is important to use Software AG logos in the exact form; especially the usage of the stylized “S” standalone is strictly forbidden. Any adjustments in the size have to be proportional. Do not change logo colors.

Software AG decides on the release of the logo usage and reserves the right restrictions and guidelines for the use to submit.

4. Proper use of Software AG company name

"Software AG" as company name must always be used as "Software AG" without any further accentuations and without the ® or ™ Symbol. Any acronyms such as "SAG" are not permitted. "Software AG" can be used as a noun or in the possessive form.

Example:
Software AG is a world leader in digital transformation.

In this case, Software AG is used to identify the company and is, therefore, not subject to trademark usage rules.

A trade name can also act as a trademark if it is also used for products and/or services. In this case, trademark usage rules will apply..

5. Software AG trademark list

Following is a non-exhaustive list of trademarks/service marks and registered trademarks/service marks owned by Software AG and/or one of its subsidiaries. These trademarks might be in Germany and/or in the U.S. and/or several other countries. There may be further existing trademarks, not listed here. This list is subject to change. Please be aware that Software AG trademarks must be shown in the below used specific stylization.
